Terms and Conditions

1) Purpose and scope

The purpose of these General Terms and Conditions is to regulate the relationship between PAGO DE LA BOTICARIA S.L. (hereinafter referred to as PAGO DE LA BOTICARIA or the Company) and you (hereinafter referred to as the Customer), relating to all transactions carried out in the Company's online store.
PAGO DE LA BOTICARIA is a Spanish company registered in the Mercantile Registry of Madrid in volume 24.210. folio 22, section 8, page M-435068.
Any incident, complaint or claim related to a purchase made through the web, must be communicated to the following email address: info@pagodelaboticaria.com 

2) Exclusions
The sale of alcoholic beverages of any alcoholic strength to minors is prohibited.
Likewise, the products offered by PAGO DE LA BOTICARIA through the Company's online store are not offered to those countries or jurisdictions where the consumption of alcoholic beverages is prohibited.

3) Acceptance and proof of acceptance
The purchase of the products must be made through the activation of the BUY button that appears at the bottom of the purchase, and also expresses the full acceptance of these General Conditions prior to the purchase of the products, without the application of any changes that may occur in the clauses of the General Conditions at a later date.

PAGO DE LA BOTICARIA will send to the Client, proof of the purchase made, with all its terms, via email provided by the Client within 24 hours after the purchase.

PAGO DE LA BOTICARIA informs the Client that it archives the electronic documents in which the purchases are formalized.

In case the Customer makes a mistake when sending the data, he/she will be able to modify them at the Customer Service Department by writing to info@pagodelaboticaria.com
If the modified data refers to the postal address where the Customer has requested the delivery of the purchased product, as long as the product has not been sent, the delivery will be made to the new address indicated. Otherwise, the Customer must wait for the delivery to become effective and then initiate the appropriate return procedures, as detailed in section 4.4.below.

4) Prices, payment, delivery and cancellation 

4.1 Prices
The prices applicable to each product are those indicated on the website on the date of the order including all VAT (Value Added Tax) and other taxes that may apply.
PAGO DE LA BOTICARIA reserves the right to make on the website, at any time and without prior notice, the changes it deems appropriate, and may update daily prices of products and services depending on the market.
Shipping costs, if any, are indicated on the order form.

4.2 Method of payment
Once the Customer has confirmed the purchase of the product, he/she must proceed to the payment of the indicated amount. Purchases can be paid by any of the following means:
- By means of the payment gateway of the entity "BBVA" with debit or credit card VISA, MASTERCARD.
- By means of the PAYPAL payment gateway.
- By any other payment gateway that PAGO DE LA BOTICARIA deems appropriate to facilitate payment to the customer.
- Bank Transfer.
The Client will notify PAGO DE LA BOTICARIA, as soon as possible, of any undue or fraudulent charge. Such notification may be made to the e-mail address info@pagodelaboticaria.com

4.3 Delivery
Deliveries are sent to the delivery address indicated by the Customer, within 24 - 96 working hours for deliveries in the Iberian Peninsula and 7 working days for the Balearic Islands, Canary Islands and European Union for products in stock. The services will be provided from Monday to Friday, excluding holidays at the destination location.

If the Client does not receive the order in the indicated term, he/she can contact PAGO DE LA BOTICARIA through the Contact section of the Web page.

In case of non-compliance with the delivery time, the compensation to be paid will consist of the refund of the cost of postage paid by the customer. It will not be considered a breach of delivery time caused by absence or change of address of the recipient, by assumptions of unknown recipient or address, non-payment of postage, closure for vacations, late deliveries on the second delivery attempt, force majeure or fortuitous event or other causes not attributable to the carrier. Likewise, it is exempt from liability in cases of failure to meet delivery deadlines in shipments to the Balearic Islands, Canary Islands or international shipments for reasons beyond the carrier's control (delays by airlines, maritime companies, third party carriers, loading or unloading, etc.).

4.4 Cancellation
PAGO DE LA BOTICARIA guarantees the Customer the possibility to cancel their order at any time, provided that the cancellation is communicated before the order has been made available to the carrier for shipment. Otherwise, the Customer must wait to receive the order before processing the return, which period is 14 working days from the date of purchase.

The Client will communicate to PAGO DE LA BOTICARIA within the stipulated period, his desire to exercise the right of withdrawal from the contract.
The returned order must be delivered together with the delivery note and, if applicable, the invoice issued by PAGO DE LA BOTICARIA, at the Customer's expense. The Customer may return any item purchased from PAGO DE LA BOTICARIA, if the products have not been opened, used and also retain their original seal or packaging. The cost of return will be calculated and communicated through our Customer Service channel. We are not responsible for packages that do not arrive at their destination, so we recommend that you use the secure tracking service for returns.

After checking the condition of the product, the amount will be refunded using the same payment method used by the customer. We will process the refund as soon as possible. However, during periods of high activity, the return may take between 14 working days to be processed.

If a product other than the one requested by the customer was delivered by mistake by PAGO DE LA BOTICARIA, the correct product will be delivered, picking up the first one, without any additional charge to the Customer.

If a product has reached the customer broken, damaged or in poor condition, PAGO DE LA BOTICARIA will take care of picking it up at the customer's address, replacing it with another in good condition, without additional charges.

5) Language
The language in which the contract between PAGO DE LA BOTICARIA and the Client is perfected is Spanish.

6) Responsibilities of PAGO DE LA BOTICARIA
PAGO DE LA BOTICARIA guarantees the quality of the service contracted through the website. All rights granted to users by current legislation are guaranteed.
Failure to comply with any of these General Terms and Conditions may result in the return of the products or the cancellation of the Services purchased by the Client.

7) Responsibilities of the Client
The Client undertakes to make lawful use of the Products and Services, without contravening current legislation, or harming the rights and interests of third parties. The Customer expressly undertakes not to allow the consumption of our wines by minors and to consume them responsibly.
The Client guarantees the truthfulness and accuracy of the data provided when filling in the contracting forms, thus avoiding causing damage to PAGO DE LA BOTICARIA.

9) Jurisdiction and Applicable Law 

In case of conflicts in the interpretation or application of these contractual conditions, in the case of final consumers, in accordance with the applicable regulations, the courts of the place of performance of the obligation or of the domicile of the purchasing party will be competent.
In the case of a purchase made by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts of Madrid (Spain).
